By downloading, installing, or using VSTAEX ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

We reserve the right to modify these Terms at any time. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

VSTAEX is a performance estimation tool designed for backend developers, system architects, and DevOps engineers. The Application provides:

  • Bandwidth analysis and network efficiency calculations
  • QPS and concurrency estimation using industry-standard formulas
  • Traffic planning and peak load analysis
  • Latency risk assessment
  • Performance visualization tools
  • Scenario management and data export/import

The Application operates entirely offline, with all data stored locally on your device.

3. License and Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal or internal business purposes.

You agree not to:

  • Copy, modify, or create derivative works of the Application
  • Reverse engineer, decompile, or disassemble the Application
  • Remove any proprietary notices or labels from the Application
  • Use the Application for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Application

4. Disclaimers

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

While VSTAEX uses industry-standard formulas and best practices for performance estimation, the results are estimates and should not be considered guarantees. Actual system performance may vary based on numerous factors including but not limited to:

  • Actual system architecture and implementation
  • Network conditions and infrastructure
  • Hardware specifications and capabilities
  • Software configurations and optimizations
  • External dependencies and third-party services

You are solely responsible for validating estimates and making final infrastructure decisions.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VSTAEX, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Application
  • Any decisions made based on estimates provided by the Application
  • Any errors or omissions in the Application
  • Any interruption or cessation of the Application

Our total liability to you for all claims arising from or related to the Application shall not exceed the amount you paid for the Application, if any.

6. Data and Privacy

VSTAEX operates entirely offline. All data, including scenarios, calculations, and settings, are stored locally on your device. We do not collect, transmit, or store any of your data on our servers.

You are responsible for backing up your data using the export functionality provided in the Application. We are not responsible for any data loss.

7. Intellectual Property

The Application, including its design, code, formulas, algorithms, and documentation, is protected by copyright, trademark, and other intellectual property laws. All rights, title, and interest in and to the Application remain with VSTAEX and its licensors.

The methodologies and formulas used in the Application (such as Little's Law) are industry standards and are not proprietary to VSTAEX. However, the implementation, user interface, and specific features are proprietary.

8. Termination

We may terminate or suspend your access to the Application at any time, with or without cause or notice, for any reason including, but not limited to, breach of these Terms. Upon termination, your right to use the Application will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Application shall be resolved in the appropriate courts.
